Can DUI Laws Be TOO Tough?

While progress has been made, drunk driving is a continuing problem in need of a solution. Far too many people make the decision to drink and get behind the wheel of a car, causing injuries and death.

But is a 0.05 BAC really the solution? Does it criminalize drinking? Will having one beer or a glass of wine at a local establishment put drivers on a path to criminal behavior?

On February 4, the National Transportation Safety Board made a variety of recommendations to reduce and eliminate drunk driving. The most high profile and controversial proposal involves states reducing blood alcohol content (BAC) levels from 0.08 to 0.05 or lower. For the fourth time in as many years, the NTSB proposed what they see as a deterrent for people under the influence getting behind the wheel.

State legislatures have yet to respond to the 0.05 clarion calls. Not even legislative committees have taken up the proposed reduction.
